Retaliation

Retaliation against employees who file discrimination or harassment claims is the #1 cause of liability in federal and state employment litigation, and it is treated as a high-risk area for employers. Protected actions include filing complaints, participating in investigations, or requesting accommodations. Employers must take zero adverse action against employees who engage in these protected activities — schedule cuts, unfavorable shift reassignments, or isolation are all illegal forms of retaliation.
